Palatine Browns Chicken Murder Suspect Asks For Tape to be Tossed

(Springfield, IL) The second defendant in the 1993 "Brown's Chicken" murders is asking the Illinois Supreme Court to throw out a videotaped interview that was made after he was arrested. Attorneys for James Degorski filed their appeal Tuesday in response to an earlier appellate court decision allowing the tape. That ruling overturned Judge Vincent Gaughan's ruling last year that the tape violated Degorski's Miranda rights. Degorski's attorneys argue that 18-hours had passed from the time their client was read his rights to the time the interview began. The court has not announced whether or not it has decided to hear the case. Co-defendant Juan Luna was convicted last year for his role in the Palatine murders and is currently serving a life sentence. Degorski faces the death penalty if found guilty.
